Inward Journey To Mind

My first Travel Blog ; Heaven on Earth :

The point is I am really passionate about travelling . I have visited many places but none as pristine and beautiful as Harshil.
What is a travel blog doing in a legal crusader's blog . Guys we also need break so here I go:-
September 2005 :- Well I had just secured an internship in the prestigious firm of Paras Kuhad and Associates and had few days with me so I decided to go to Gangotri little did I knew that that I will get much more than I thought .
Travel till Gangotri :- Well I boarded a bus of Uttranchal tourism which took me to Rishikesh from the Delhi ISBT ( Interstate Bus Terminus) and it took me nearly 14 hours to reach Rishikesh ( Wont be able to elaborate on my stay in Rishikesh because it was restircted to bus stand) .
From there I took a small rickety bus towards Uttarkashi a beautiful township located in scenic valleys of Utttranchal . The roads were really narrow and I couldnt help but marvel at the amazing dexterity shown by the driver it took my breath away ! really.
Bus halted just once and I feasted myself to a tasty spread of Hot Pakoras and one sugary sweet only found in Uttranchal . It goes without saying that it was really delecious ( or was it hunger which made it doubly delecoius).
And so I reached Uttarkashi . My blog wont be complete without writing about Uttarkashi but guys since my focus is on Harshill am gonna give it as well as Gangotri a slip but let me assure you my next travel blog will be on them.
I stayed one day in Uttarkashi ( If you guys are wondering why it is known as Uttarkashi watch out my next blog) in the beautiful Tapovan kuti where pure and pristine Great Ganges flowed in all its splendour just a few feet away from my room (Wow ! what a feeling even now when I think about that place I feel myself bathing in the cold waters of ganges surrounded by hills and chirping birds among the chanting of holy hymns coming from the nearby temples the whole atmosphere was radiating a positve radiation and kind of unexplainable innocence....truly mesmerizing and surreal ! really time stood still that day more of that later)
The next day we boarded a Sumo to Gangotri . Not many people are aware that enroute to Gangotri falls a peaceful and pristine place where Ganges flow in her privacy far away from maddening crowd of civilization guarded by the Indian Army .
Yes ! I am refering to Harshil an Army Cantonment .
If anyone of you paln to go to Gnagotri please visit this place the memories you take you will cherish forever.
And so I reached the Harshil which is really a heaven on earth ( Without taking away anything away from J&k ).
One warning Foreigners are not allowed there and there is a big board proclaiming the same.
So I entered Harshil .
As soon as I entered the Harshil I could see Juicy red apples dangling from the apple trees within my arms reach . I could smell the scent of apples in the crisp and cold air . Shivering I made my way to a Small but amazingly beautiful Hotel there.
The owner of the Hotel was our acquintance so I was able to secure the best Room . From the big room window I could see tall mountains and snowy peaks all around me surrrounded by lush hilly trees.
Next day I decided to explore Harshil ( The Army Cantonment is off limits until and unless you yourself are in the Army). So I went the opposite way . I was amazed to see the magnificent Ganges flowing in her full glory cutting across mountains . It was really amazing site .
There were no signs of human civilization or so I thought. I felt no fear and continued going forward.
I enter a different world :- Suddenly a village appeared in front of me straight out of the book of
"Seven Years in Tibet " ( In case you have not read it please do it an amazing piece of history of what Tibet was).
I could hear buddhist chants filling the atmosphere generating a positive energy field which lifted me many notches above this materialistic world . Lo and behold I was in a Tibetian Village among Tibetians speaking Hindi better than me and still preserving their culture . The amount of respect and love they have for the present Dalai Lama is really amazing.
Well I have been to Dharamshala also (of which I will write later ) Which also have Tibetians but I am sorry to say mass commercialisation has affected their natural innocence for which Tibetians are famous for more of that later)
I also made a Tibetian friend who was high on dope and thanks to him I was able to savour the delecious slice of Tibetian culture. Strangely I felt no fear roaming with him carrying valuables in the isolated place with I being the only native Indian . This was the power of those surroundings which filled me with love and took out all negative emotions.
The people of Harshil stay in mud houses and are basically engaged in the cultivation of apples and also a delecious variety of Rajma prepared with a typical hilly herb with a sharp and pungent taste.
I was invited to one of the houses and was offered butter tea which frankly I didnt like , but their sweetness more than made up for the saltiness in the tea.
I purcahsed lot of apples and Rajma from them . They offered as a custom few complementary apples ( one apple for a kg purchased to be precise)
I took one juicy bite of the crisp apple and I knew I have tasted heaven .
It was full of juice which flowed from my mouth till my elbows I unabashdely licked the juice like a toddler and I knew I have seen the heaven I closed my eyes and streched my experience as long as I could savouring the truly enchanting experience . ( I also purchased few shalls and a white sweater from them ,really nice !)
I have not described the people of that Village . Well they were as red as a ripe apple . Women were really beautiful with flawless complexions and and even sweeter nature . The best part was they were really happy as they were and one could feel the satisfaction on their faces which made them look even more radiant.
I sat on the rock near ganges and meditated . Time had stood still and I could only hear the running waters of pure and eternal ganges.
I wished I could stay in that place forever ! maybe in next birth.
Next day I resumed my journey but not before eating tasty omellete and drinking sugary tea prepared by a ex hawaldar from Army who has made Harshil his home. So lucky Tskkkk. .
P.S.:- I am giving a miss to many other incidents like my chance meeting with a prominent congress leader of yesteryears who is hiding there as a pujari in a temple . My conversations with my Tibetian friend . A wedding ceremony between a Tibetian and a Doctor from Ludhiana (Love marriage you see) .
So ended my sojourn to a world beyond ......Maybe I have discovered Shangrila ( A mythical place where everybody is happy and peaceful and all people radiate a positive and energy . Please read Legend of Shangrila and Tenth Insight by Jmaes Redfield for more information about this eutopian place).
Bye guys . Next time I may write something about my inward journey watch out.

Greatest Poem :Rabindra Nath Tagore

Where the head is held high;
Where knowledge is free;
Where the world has not been broken up into fragments by narrow domestic walls;
Where words come out from the depth of truth;
Where tireless striving stretches its arms towards perfection;
Where the clear stream of reason has not lost its way into the dreary desert sand of dead habit;
Where the mind is led forward by thee into ever-widening thought and action
P.S. :- Guys check out this link.http://www.schoolofwisdom.com/gitanjali.html .It is a great collection of poems by the Great Rabindranath Tagore. For this great son of soil. Jai Ho!

Redudant Laws

About two-thirds of our laws have not been used in independent India.
About 10 per cent of them can be scrapped right away.
And most of the 10 per cent in use currently have so many obsolete and conflicting provisions that they serve far more as instruments of harassment than effective means of justice.
The oldest law in the country has been in operation for over a century and half. The one sentence 1836 Bengal District Act empowers the Bengal government to create as many zillas as it wants. The Act still exists.
As do a host of other like the Indian Post Office Act of 1885, the Indian Evidence Act of 1850 or the Indian Sarais Act of 1867. Most of them cater to a colonial and feudal socio-economic environment. And they exists side by side, mostly in complete disharmony, with the Acts passed by independent India, the Industrial Disputes Act of 1947, the Companies Act of 1956 and the Patents Act of 1970 (replacing the 1911 Act) and the Act last passed, the amended Copyright Act, 1994.
Under the Indian Sarais Act, 1867, it is a punishable offence for ‘inn-keepers’ not to offer free drinking water to passer-by. Recently, a Delhi five-star hotel was taken to court by the municipal corporation on the grounds that the hotel was not doing so.
Only about 40 per cent of our laws are in regular use. Independent India has till now found no conceivable use for the rest.
The Indian Telegraph Act, which was passed in 1885, when the concept of television obviously didn’t exist, has been invoked five times in the past three years by Doordarshan over telecast rights of cricket matches played in India. This very nearly derailed the telecast of the 1996 World cup.
In the past century and a half, the socio-economic framework of the country has undergone radical changes, but the legal structure has failed to keep pace with it.
While India badly needs efficient laws, the time spent by the law-making body on the job is unbelievably little. Parliament spends less than 0.6 per cent of a Lok Sabha day on law-making.Surprised Ponder over it !
Optimist Creed : Way to Live.

The Optimist Creed
Promise Yourself…
To be so strong that nothing can disturb your peace of mind.
To talk health, happiness, and prosperity to every person you meet.
To make all your friends feel that there is something worthwhile in them.
To look at the sunny side of everything and make your optimism come true.
To think only of the best, to work only for the best and to expect only the best.
To be just as enthusiastic about the success of others as you are about your own.
To forget the mistakes of the past and press on to the greater achievements of the future.
To wear a cheerful expression at all times and give a smile to every living creature you meet.
To give so much time to improving yourself that you have no time to criticize others.
To be too large for worry, too noble for anger, too strong for fear, and too happy to permit the presence of trouble.
To think well of yourself and to proclaim this fact to the world, not in loud word, but in great deeds.
To live in the faith that the whole world is on your side, so long as you are true to the best that is in you.
Cheers !
Brilliant Speech by Chetan Bhagat

Good Morning everyone and thank you for giving me this chance to speak to you. This day is about you. You, who have come to this college, leaving the comfort of your homes(or in some cases discomfort), to become something in your life. I am sure you are excited. There are few days in human life when one is truly elated. The first day in college is one of them. When you were getting ready today, you felt a tingling in your stomach. What would the auditorium be like, what would the teachers be like, who are my newclassmates - there is so much to be curious about. I call this excitement, the spark within you that makes you feel truly alive today. Today I am going to talk about keeping the spark shining. Or to put it another way, how to be happy most, if not all the time.Where do these sparks start? I think we are born with them.My 3-year old twin boys have a million sparks. A little Spiderman toy can make them jump on the bed. They getthrills from creaky swings in the park. A story from daddy gets them excited. They do a daily countdown for birthday party – several months in advance – just for the day they willcut their own birthday cake.I see students like you, and I still see some sparks. But when I see older people, the spark is difficult to find. That means as we age, the spark fades. People whose spark has faded too much are dull, dejected, aimless and bitter. Remember Kareena in the first half of Jab We Met vs the second half? That is what happens when the spark is lost. So how to save the spark?Imagine the spark to be a lamp’s flame. The first aspect is nurturing - to give your spark the fuel, continuously. The second is to guard against storms.To nurture, always have goals. It is human nature to strive, improve and achieve full potential. In fact, that is success. It is what is possible for you. It isn’t any external measure - acertain cost to company pay package, a particular car or house.Most of us are from middle class families. To us, having material landmarks is success and rightly so. When you have grown up where money constraints force everyday choices,financial freedom is a big achievement.But it isn’t the purpose of life. If that was the case,Mr Ambani would not show up for work. Shah Rukh Khan would stay at home and not dance anymore. Steve Jobs won’t beworking hard to make a better iPhone, as he sold Pixar for billions of dollars already. Why do they do it? What makes them come to work everyday?They do it because it makes them happy. They do it because it makes them feel alive. Just getting better from current levels feels good. If you study hard, you can improve yourrank. If you make an effort to interact with people, you will do better in interviews. If you practice, your cricket will get better. You may also know that you cannot becomeTendulkar, yet. But you can get to the next level. Striving for that next level is important.Nature designed with a random set of genes and circumstances in which we were born. To be happy, we have to accept it and make the most of nature’s design. Are you? Goalswill help you do that. I must add, don’t just have career or academic goals. Set goals to give you a balanced, successful life. I use the word balanced before successful. Balanced means ensuring yourhealth, relationships, mental peace are all in good order.There is no point of getting a promotion on the day of your breakup. There is no fun in driving a car if your back hurts. Shopping is not enjoyable if your mind is full of tensions.You must have read some quotes - Life is a tough race, it is a marathon or whatever. No, from what I have seen so far, life is one of those races in nursery school. Where youhave to run with a marble in a spoon kept in your mouth. If the marble falls, there is no point coming first. Same with life, where health and relationships are the marble. Your striving is only worth it if there is harmony in your life. Else, you may achieve the success, but this spark, this feeling of being excited and alive, will start to die.One last thing about nurturing the spark - don’t take life seriously. One of my yoga teachers used to make students laugh during classes. One student asked him if these jokeswould take away something from the yoga practice. The teacher said - don’t be serious, be sincere. This quote has defined my work ever since. Whether its my writing, my job,my relationships or any of my goals. I get thousands of opinions on my writing everyday. There is heaps of praise, there is intense criticism. If I take it all seriously, how will Iwrite? Or rather, how will I live? Life is not to be taken seriously, as we are really temporary here.We are like a pre-paid card with limited validity. If we are lucky, we may lastanother 50 years. And 50 years is just 2,500 weekends. Do we really need to get so worked up? It’s ok, bunk a few classes, goof up a few interviews, fall in love.We are people, notprogrammed devices.I’ve told you three things - reasonable goals, balance and not taking it too seriously that will nurture the spark. However, there are four storms in life that will threaten tocompletely put out the flame. These must be guarded against. These are disappointment, frustration, unfairness and loneliness of purpose.Disappointment will come when your effort does not give you the expected return. If things don’t go as planned or if you face failure. Failure is extremely difficult to handle, butthose that do come out stronger. What did this failure teach me? is the question you will need to ask. You will feel miserable. You will want to quit, like I wanted to when ninepublishers rejected my first book. Some IITians kill themselves over low grades – how silly is that? But that is how much failure can hurt you.But it’s life. If challenges could always be overcome, they would cease to be a challenge. And remember - if you are failing at something, that means you are at your limit orpotential. And that’s where you want to be.Disappointment’s cousin is frustration, the second storm. Have you ever been frustrated? It happens when things are stuck. This is especially relevant in India. From traffic jamsto getting that job you deserve, sometimes things take so long that you don’t know if you chose the right goal. After books, I set the goal of writing for Bollywood, as I thought theyneeded writers. I am called extremely lucky, but it took me five years to get close to a release.Frustration saps excitement, and turns your initial energy into something negative, making you a bitter person. How did I deal with it? A realistic assessment of the time involved –movies take a long time to make even though they are watched quickly, seeking a certain enjoyment in the process rather than the end result – at least I was learning how to writescripts , having a side plan – I had my third book to write and even something as simple as pleasurable distractions in your life - friends, food, travel can help you overcome it.Remember, nothing is to be taken seriously. Frustration is a sign somewhere, you took it too seriously.Unfairness - this is hardest to deal with, but unfortunately that is how our country works. People with connections, rich dads, beautiful faces, pedigree find it easier to make it – notjust in Bollywood, but everywhere. And sometimes it is just plain luck. There are so few opportunities in India, so many stars need to be aligned for you to make it happen. Meritand hard work is not always linked to achievement in the short term, but the long term correlation is high, and ultimately things do work out. But realize, there will be some peopleluckier than you.In fact, to have an opportunity to go to college and understand this speech in English means you are pretty darn lucky by Indian standards. Let’s be grateful for what we have andget the strength to accept what we don’t. I have so much love from my readers that other writers cannot even imagine it. However, I don’t get literary praise. It’s ok. I don’t looklike Aishwarya Rai, but I have two boys who I think are more beautiful than her. It’s ok. Don’t let unfairness kill your spark.Finally, the last point that can kill your spark is isolation. As you grow older you will realize you are unique. When you are little, all kids want Ice cream and Spiderman. As yougrow older to college, you still are a lot like your friends. But ten years later and you realize you are unique. What you want, what you believe in, what makes you feel, may bedifferent from even the people closest to you. This can create conflict as your goals may not match with others. . And you may drop some of them. Basketball captains in collegeinvariably stop playing basketball by the time they have their second child. They give up something that meant so much to them. They do it for their family. But in doing that, thespark dies. Never, ever make that compromise. Love yourself first, and then others.There you go. I’ve told you the four thunderstorms - disappointment, frustration, unfairness and isolation. You cannot avoid them, as like the monsoon they will come into your lifeat regular intervals. You just need to keep the raincoat handy to not let the spark die.I welcome you again to the most wonderful years of your life. If someone gave me the choice to go back in time, I will surely choose college. But I also hope that ten years later aswell, you eyes will shine the same way as they do today. That you will Keep the Spark alive, not only through college, but through the next 2,500 weekends. And I hope not justyou, but my whole country will keep that spark alive, as we really need it now more than any moment in history. And there is something cool about saying - I come from the landof a billion sparks.Thank You
HDFC : Faulty ATM Machine
DAY 2 :- Legal Crusade
Well I had just secured addmission to a law college ( Army Institute of Law) . I was all charged up and being fed on a steady dose of John Grisham was determined to bring a change and as they say charity begins at home I got my oppurtunity well at home and so started my legal crusade.
Legal Crusade against HDFC:- Faulty ATM machine:- Well what happened was that my sister was in need of money and it was 12 at night.
We had HDFC ATM quie nearby , so we reached the ATM (Any Time Money) well it is meant for it wasnt it.(Actually it is Automated Transaction Machine)
We inserted the card . The machine was faulty , the money was debited and the card got stuck and with urgent need of cash and no source for it It created a panic situation we somehow survived it but it put me on my path of legal crusade.
I served notice to HDFC BANK claiming damages for mental harrasement and agony.
Following were the facts 0f my first drafted plaint:-
ATM are meant for emergency withdrawal of cash and although it is treated as a replacement of banks today it primary function of cash withdrawal at any time could not be dispensed with.
Just imagine you went to your bank for withdrawing 5000 Rs and bank says they dont have cash to give . Ponder over it. Combine it with an emergency situation like I had and the situation turns really awful .
The Bank took the defence of machine error .
My point is in vicarious liability if a master is held liable for the mistake of servant cant the same logic applied to ATM machines.
Agreed it was a machine but who have the duty of maintaing machines ?
Well who won ? nobody I tried to file a case in the consumer court but the reality struck quite early it is not easy to fight against big sharks and I had neither time nor resources to do that.
But my crusade has started in my next blogs I will be bringing many more of my legal crusades and I have something for my friends in LPO industry just keep watching this space .
Bye.
